GENERAL CONDITIONS OF SALE
Preamble
These terms and conditions of sale are entered into by the company HUNA, whose registered office is located at 56 rue des Bégonias, 97419 La Possession (Réunion Island), registered under the SIRET number 420 132 342 00072 in the name of Sébastien BRICHE, hereinafter referred to as “the Seller,” who operates the website hunamassage.re, hereinafter referred to as “the Website,” and on the other hand, by any natural or legal person wishing to make a purchase via the website hunamassage.re, hereinafter referred to as “the Buyer.”
Article 1. Purpose
These terms and conditions aim to define the contractual relationship between the Seller and the Buyer, as well as the conditions applicable to any purchase made through the Website.
The purchase of a service through this Website implies the Buyer’s full and unconditional acceptance of these terms and conditions, which the Buyer acknowledges having read prior to placing the order.
The Seller reserves the right to modify these terms and conditions at any time, in order to comply with new regulations or to improve the use of the Website. Therefore, the applicable conditions will be those in effect on the date the Buyer places the order.
Article 2. Services and Products
The services and products offered are those listed on the Seller’s Website. The Seller reserves the right to modify the selection of services or products at any time.
Each service and product is presented on the Website with a description outlining its main characteristics. The photographs are as accurate as possible but are not contractually binding on the Seller.
The services and products offered comply with current French legislation and applicable standards in France.
The sale of services and products presented on the Website is intended for buyers residing in Réunion Island.
Article 3. Pricing
HUNA operates under the micro-enterprise status, which means that sales are exempt from VAT: according to Article 293 B of the French General Tax Code, VAT is not applicable. The prices listed in the online catalog for services and products are shown in Euros (€).
The Seller reserves the right to change prices at any time; however, the price listed in the catalog on the date of the order shall be the only price applicable to the Buyer.
Article 4. Orders and Reservations
Orders and bookings made on the Website are reserved for individual customers. The HUNA Website offers several services: booking massages with online payment, purchasing gift cards, purchasing packages (multiple massages at a reduced price), and online product sales.
The Seller offers the Buyer the possibility to book a massage through the following steps:

Optional creation of an account containing the Buyer’s information (full name, email address, and mobile phone number)

Payment. The Buyer has access to secure payment by credit card. The Buyer is redirected to a secure interface to safely enter their card details. If the payment is accepted, the order is recorded, and the contract is definitively concluded. This final click constitutes the conclusion of the contract. Confirmation implies acceptance of these terms and conditions of sale.
The Seller also allows the Buyer to offer a gift card through the following steps:

The purchase of a package requires the creation of a customer account. Package subscriptions are valid for 1 year from the date of purchase and are non-refundable.

Products are not delivered. The Buyer must pick them up in person at one of the massage locations by contacting HUNA at +262 692 02 57 29 and scheduling the desired pickup date.
Bookings using packages can be made:
Online on the Website, under the “Book a massage” section by selecting the “Package” payment option
By phone at +262 692 02 57 29, by providing the Buyer’s name, the purchased package, the desired massage, and the selected dates and time slots
Order Summary
Once validated and payment is confirmed, the Buyer receives an email confirmation at the address previously provided, acknowledging the order has been recorded.
Secure Payment
The information transmitted is encrypted according to best practices and cannot be read during transmission over the network. Once the Buyer initiates payment, the transaction is immediately debited after verification of the information. In accordance with Article L.132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By providing their banking information during the transaction, the Buyer authorizes the Seller to debit their card for the amount corresponding to the stated price.
The Buyer confirms that they are the legal holder of the card to be debited and are legally entitled to use it. In case of error or inability to debit the card, the sale is automatically canceled and the order annulled.
Account Registration Conditions
When placing an order, the Buyer is asked to provide their full name, email address, and mobile phone number (without having to create an account). However, a personal account can be created for the Buyer on the Website. This account allows the Buyer to store order information and future transactions. The Buyer will be asked to create a personal password to access this account. The Buyer agrees to keep their login details confidential and never disclose them to third parties. Consequently, any purchase made using these credentials will be deemed to have been made by the Buyer who owns the account. In case of loss, theft, or fraudulent use of the password, the Buyer agrees to immediately inform the Seller.
Account creation is free. The login and password allowing access to the Website are confidential and must not be disclosed to third parties. After creating the account, the Buyer will receive a confirmation email.
The Buyer may request the deactivation of their account at any time by sending an email to Customer Service. After deactivation, the Buyer is free to create a new account at any time.
Use of the Customer Account
Through their customer account, the Buyer can view past orders, manage, and save their personal information.
Contractual Information
The data recorded by the Seller constitutes proof of all transactions made between the Seller and the Buyer. Contractual information is presented in French and confirmed by email.
The Buyer must ensure the completeness and accuracy of the information provided to the Seller, who cannot be held responsible for any data entry errors.
Late Booking Limit
The Buyer may book a session up to one day before the appointment.
Cancellation of Reservation
Once validated, the reservation is transmitted to the Seller and the selected time slot is blocked in the schedule.
To cancel or reschedule a session, the Buyer may modify their reservation via their customer account under the “My Reservations” section or by contacting HUNA at +262 692 02 57 29 at least 72 hours in advance. Any reservation not canceled at least 72 hours in advance will be considered due.
Validity of Gift Cards
HUNA gift cards are valid for 2 months from the date of purchase and are non-refundable.
Refusal of Orders
The Seller reserves the right not to accept an order from a Buyer with whom there is an ongoing dispute regarding a previous order, or if the Seller reasonably believes that the Buyer has violated these General Terms and Conditions or has engaged in fraudulent activity, or for any other legitimate reason.
Proof of Transaction
The Seller recommends that the Buyer keep a reliable electronic record of all data related to their order.
Security and Archiving
Computerized records stored in the Seller’s computer systems under reasonably secure conditions will be considered as proof of communications, orders, and payments between the parties. The archiving of order forms and invoices is carried out on a reliable and durable medium that may be produced as evidence.
Billing
The Buyer agrees to receive invoices exclusively in electronic format.
Article 6. Service Availability
The Buyer’s credit card is charged at the time of payment confirmation.
In the event that a service becomes unavailable after an order has been placed (e.g. simultaneous booking of the same time slot), the Seller will inform the Buyer by email or phone as soon as possible and offer one of the following options:

Cancellation of the order
Cancellation of the order will result in a refund of the cancelled service(s); in this case, the Seller will refund the bank account used for the purchase within a maximum of fourteen (14) business days.
The Seller shall not be held liable for the unavailability of services.
Article 7. Liability
The Seller shall not be held liable for any damages resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional issues.
Article 8. Personal Data
The Seller undertakes to maintain the confidentiality of the information provided by the Buyer, which may be transmitted in the course of using the services of the Website. All such information is subject to the provisions of French Law No. 78-17 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code, the European Directive of October 24, 1995, and Regulation (EU) 2016/679 known as the General Data Protection Regulation (GDPR). As such, the Buyer has the right to access, modify, and delete personal information concerning them. This request may be made at any time by email addressed to the Seller.
Article 9. Dispute Resolution
These distance selling conditions are subject to French law. In the event of a dispute, the Buyer shall first contact the Seller to seek an amicable solution.
These General Terms and Conditions of Sale are written in French and shall be executed and interpreted in accordance with French law. Any dispute that may arise regarding their validity, interpretation, or execution shall be submitted to the French courts, which shall have exclusive jurisdiction. The Buyer acknowledges acceptance of their exclusive jurisdiction. The Seller reserves the right to seek and obtain injunctions or orders to defend its rights hereunder.
